Appealing Your Family Law Case
In New Jersey, you generally have the right to appeal the final judgment in a family law case, such as a divorce, child custody, or support matter, to the Appellate Division of the Superior Court. Appealing non-final (interlocutory) orders requires the court’s special permission.
The notice of appeal must be filed within 45 days from the date of the final order or judgment’s entry (docketing) by the court clerk. This is a strict deadline, and failure to file within this timeframe can result in the dismissal of your appeal. However, the Appellate Division may grant a single, limited extension for up to 30 days upon a showing of good cause, but no further extension is permitted.
The appeal process involves submitting legal briefs and potentially participating in oral arguments to convince the appellate court that the lower court made an error of law or abused its discretion. The appellate court gives significant deference to the trial court’s factual findings.
In a New Jersey family law suit, both parties are permitted to appeal a trial court ruling if they are dissatisfied with the result. The case then goes to appellate court, where the client – with the assistance of an experienced appellate attorney – can ask the court to review the case and overturn the judgment.
